4 Reasons Your ILR Application May Get Refused

Receiving a refusal message on your Indefinite Leave to Remain (ILR) application can cause a crushing disappointment. From gathering paperwork to completing all the requirements is a detailed task, you’ve gone through all the rigorous processes.  And if the Home Office rejects your application, anxiety, and stress escalates extremely quickly.

However, an ILR application is never refused without substantial reasons. At Wembley Solicitors, we deal with various UK immigration clients who have faced an ILR rejection.

To help save you from the hassle, we’ve curated this blog to highlight all the possible reasons an ILR application may get rejected.

Insufficient Documentation

The first and most common reason why many UK visa applications get refused on daily basis is incomplete documentations. The Home Office is extremely strict about proper documentation procedures. And they don’t hesitate to reject an ILR application if it doesn’t meet the required paperwork, attestation, and evidence requirements. Some of the most common reasons for ILR refusal include:

  • Missing paperwork
  • A document in a language other than English (UK)
  • Translated documents without translator’s details
  • Copy documents instead of originals
  • Missing evidence, etc.

Character Anomalies

Under the UK Immigration rules section 322 (5), an applicant should not represent a threat to national security. This article also requires the applicant to be a tax-compliant individual with clear financial track records. They should not bear any kind of association with criminals or terrorists.

Too Many Absences

ILR is not granted to individuals who have been out of the United Kingdom for more than 180 days. Gaps in UK residency can lead to ILR application refusal and will also require the applicant to reset their period clock to qualify for ILR.

In case of excessive absences, you will be required to provide evidence and explanation. This exception, however, is only for Tier 1 visa holders.

Excessive absences may require an explanation in support of your application. The only exception to this rule is Tier 1 visa holders, who are not required to give evidence of absences from the UK.

Failure to Disclose Due Debt

Another common reason for ILR rejection is an applicant’s failure to disclose their due debt and money management irregularities. Home Office tends to investigate the financial capacity of applicants even if they’re fully debt-free.

Therefore, it’s extremely important for ILR applicants to provide a comprehensive and complete status of their debt and payment plans. Moreover, borrowers also need to provide evidence that they’re able to pay off the remaining loan without any financial constraints.
