The money you are entitled to depends on the following factors:<\/p>\n<ul>\n<li>Where your partner worked<\/li>\n<li>When your partner retired<\/li>\n<li>When your partner died<\/li>\n<li>Whether or not you\u2019ve waived your survivor\u2019s benefits.<\/li>\n<\/ul>\n<p><!--more--><\/p>\n<p>A spouse needs to be over the <a href=\"https:\/\/www.gov.uk\/state-pension-age\"><u>state pension age<\/u><\/a>\u00a0to claim their partner\u2019s pension. You may get extra pension payments depending on your partner\u2019s National Insurance Contributions. If you are under the State Pension age, you won\u2019t be entitled to your partner\u2019s pension if you:<\/p>\n<ol>\n<li>Form a new civil partnership<\/li>\n<li>Remarry<\/li>\n<\/ol>\n<p>The amount of State Pension you&#8217;ll receive depends on when you reach your State Pension age. If you reach your State Pension age before <a href=\"https:\/\/www.gov.uk\/death-spouse-benefits-tax-pension\/pensions\"><u>6<\/u><u><sup>th<\/sup><\/u><u>\u00a0April 2016<\/u><\/a>, you&#8217;ll get your spouse&#8217;s pension according to his NIC contributions. If you reach the State Pension age after this date, you&#8217;ll be entitled to the New State Pension and receive extra payment on top of your pension.<\/p>\n<h3><strong><b>Additional State Pension <\/b><\/strong><\/h3>\n<p>Your partner may have contributed to an Additional State Pension, previously known as State Earnings-Related Pension Scheme (SERPS). You are entitled to <a href=\"https:\/\/www.rights4seniors.net\/content\/inheriting-asp\"><u>receiving 50%<\/u><\/a>\u00a0of this money regardless of when your spouse died.<\/p>\n<p>You can only inherit a <a href=\"https:\/\/www.gov.uk\/new-state-pension\/what-youll-get\"><u>maximum amount<\/u><\/a>\u00a0with Additional State Pension. It can\u2019t be more than \u00a3180.31\/week if you have your own Additional State Pension. Nevertheless, the actual amount will depend on your <a href=\"https:\/\/www.gov.uk\/new-state-pension\/your-national-insurance-record-and-your-state-pension\"><u>National Insurance Record<\/u><\/a>.<\/p>\n<h3><strong><b>How it\u2019s Paid <\/b><\/strong><\/h3>\n<p>&nbsp;<\/p>\n<p>After claiming your spouse&#8217;s pension, you&#8217;ll receive a letter about your payments. You&#8217;ll get paid every four weeks in your account. Also, you&#8217;ll not be paid in advance but in arrears, i.e., for the past four weeks.<\/p>\n<p>After you\u2019ve reached your State Pension age, you\u2019ll receive your first payment in 5 weeks. After that, it\u2019ll be <a href=\"#toc-6\"><u>every four weeks<\/u><\/a>. The letter will inform you of what to expect.<\/p>\n<p>Your National Insurance number will decide the day you\u2019ll get paid. If your payment day is a holiday, you\u2019ll get paid earlier.<\/p>\n<h3><strong><b>Private Pensions <\/b><\/strong><\/h3>\n<p>You may also receive payments from your spouse\u2019s workplace, depending on the pension scheme they chose.
