What is a Power of Attorney?
A power of attorney is a formal legal document that authorises one or more people (known as "attorneys") to represent or act on another's behalf in private affairs, business, or some other legal matter.
In other words, you can appoint someone to act on your behalf and make decisions for you, if you're no longer able to make your own decisions or you no longer want to make your own decisions.

What is Ordinary Power of Attorney?
An ordinary power of attorney lets you appoint someone (known as an ‘attorney’) to look after your financial affairs for a temporary period and make decisions on your behalf. It will end if you lose your mental capacity to make decisions.
What is a Lasting Power of Attorney (LPA)?
A lasting power of attorney (LPA) is a formal legal document that allows your attorney the power to make decisions on your behalf about your daily routine, medical care, property, and financial affairs.
When you make your lasting power of attorney (LPA), you must be 18 or over and have mental capacity. Mental capacity means you must be able to make your own decisions when you make your LPA.
There are 2 different types of lasting power of attorney (LPA):

Health and welfare lasting power of attorney
You can make "health and welfare" lasting power of attorney if you're unable to make your own decisions and willing to grant permission to someone to make decisions about your daily routine, medical care, moving into a care home and life-sustaining medical treatment.
Property and financial affairs lasting power of attorney
You can make a "property and financial affairs" LPA to grant permission to someone to make decisions about money and property on your behalf such as managing a bank account, paying bills, selling your home and so on.
What is an Enduring Power of Attorney (EPA)?
An Enduring Power of Attorney (EPA) gives permission to someone to deal only with property and financial affairs, not with personal welfare issues.
On 1st October 2007, the Lasting Power of Attorney (LPA) came into force under the Mental Capacity Act 2005. Before that, people made an Enduring Power of Attorney (EPA). It is no longer possible to make an enduring power of attorney, but an enduring power of attorney made before October 2007 remains valid.
Do you need a solicitor to make a Lasting Power of Attorney (LPA)?
It is not mandatory to use a solicitor’s legal services to make a power of attorney. The application forms from the Office of the Public Guardian (OPG) contain guidance to help you fill them out.
