The fiancé visa is a type of visa in the UK which enables individuals who are residents of the UK, to sponsor their fiancés to join them. The one sponsoring the fiancé visa should be a UK citizen without any sort of immigration restrictions on the length of their stay.

Another name for fiancé visa is prospective marriage visa, and is different from other partner visa categories, as it allows an individual to apply for the visa without having to live together with their partner for certain duration of time. If a UK citizen is returning to live in the UK, they can apply for the fiancé visa to take their fiancé along with them.

Requirements

Like all other visas, there is certain criterion that the applicants must fulfil in order to apply for fiancé visa. Here are few of the requirements:

  • The sponsor and their fiancé should be more 17 years of age
  • The sponsor and their fiancé should have met each other at some point in their life
  • The sponsor and their fiancé should be intending to live together after marriage
  • The sponsor and their fiancé should show that any of their previous legal relationship is over
  • The sponsor and their fiancé should be able to support themselves financially
  • The sponsor should have a minimum of £18,600 per annum in income or savings in order to support the family
  • The sponsor and their fiancé should have a suitable accommodation to start a family

Length of a Fiancé Visa

A fiancé visa is granted for a period of six months in which period the sponsor should marry their fiancé. Once the marriage takes place, the couple can apply for spouse visa. Spouse visa is usually granted for a period of 30 months initially, and enables an individual to work in the UK.

After spending about five years on spouse visa, the individual is eligible to apply for ‘Indefinite leave to remain’ (ILR) or ‘Permanent Residency’ (PR). This removes all restrictions and time limits on the stay within the UK, and an individual is completely free to study or take employment. However, an ILR or PR is only granted if the marriage is subsisting after five years and the individual continues to meet their financial requirements.

If a sponsor and their fiancé have children together who are under the age of 18, then they can only be taken into UK as dependents. It is important to prove that it would cause serious problems to the family if the children and the fiancé are not allowed to enter the UK at the same time.

A better route in this case for the sponsor is to marry their fiancé before applying for entry.
