My Visa Has Been Rejected, How Do I Go About An Immigration Appeal?

Applied for a UK visa, but faced rejection? Don’t worry. You have the right to file an appeal against the decision.

The government of UK has provided guidelines regarding what you can do in such situations.

Here’s what you should know:

If You Applied For Visa from Within UK

You can appeal in the tribunal against the decision only if it has been stated in the decision letter. Make sure you consult a solicitor or a lawyer for assistance in such cases.

After the rejection, you have a period of fourteen days in which you can appeal against the decision. In case, you apply after missing the deadline, the tribunal will decide if they still want to hear your appeal.

You can apply either online or via fax or post. Just make sure you submit all the necessary documents. It is up to you if you want the decision to be made based on the information you have provided in the form or in a separate hearing.

In some cases, the tribunal might decide to conduct a hearing even if you did not file a request for it. The hearing is carried out in public.

If You Applied For Visa from Outside UK

In this case, you have 28 days after the decision to decide if you want to make an appeal or not. Similar to the aforementioned process, you have the right to request a hearing.

In case there is no hearing, the tribunal will give the decision based on the information you have provided in the form and documents.

What Happens In Case Of A Hearing?

In case of a hearing, you will get a letter which gives details about the hearing. In case you are not able to attend the hearing on your own, you will have to ask someone to represent you in the court. Some of the people who will be present during the hearing include:

  • The judges
  • The people who represent you
  • The witnesses

Your home officer and the sponsor can also attend the hearing.

The Decision

You will receive the final decision either by post or in person. Whatever, decision the tribunal takes, you will get it in writing after about four weeks.

The home office will revise the decision if you win the appeal. In case you lose the appeal, you have the option of appealing to the upper tribunal.
