Who is Liable in a Car Crash?

After a car accident, it’s important to determine liability in order to compensate for the injuries caused by it. Insurance companies investigate the accident along with solicitors hired by the affected parties to determine who was at fault. The car type, witnesses, and other factors are also taken into account.

The driver is determined to be at fault if they were:

  1. Reckless:When a driver drives aggressively, is intoxicated, or is texting while driving
  2. Negligent:When the driver is careless while driving

So, the fault is determined in proportions, and the accidents are analyzed thoroughly to assess liability.

Types of Accidents

3. Rear-End Collisions

These are the most common types of accidents and occur when a car collides into the back of another car. When a driver is driving too closely to the car in front or doesn’t pay proper attention, rear-end collisions tend to occur. It is usually the fault of the car that hits the rear-end as traffic rules always state to maintain a certain amount of distance in order to slow down if any unpredicted circumstances occur.

4. Left-Turn Accidents

Left-turn accidents occur when one of the vehicles is traveling straight while the other takes a left turn and collides in the side. The responsibility usually falls upon the driver turning left as they have to be careful and aware of the green light. The speed of the straight-moving car is also assessed to check if that driver may also be at fault.

5. Head-On Collisions

A head-on collision is one of the most dangerous types of accidents and incurs major losses to both parties. These can also result in fatalities and major injuries to the vehicle occupants. This type of accident usually occurs when a car changes its lane and enters a wrong-way road. The fault lies on the driver who changed lanes.

6. Side-Impact Collisions

These are also known as T-bone accidents, as one car going straight hits the other car right in the middle of its side at a 90-degree angle. These accidents usually occur at an intersection when one of the cars tries to run a red light due to drunk driving or if the driver is not paying attention to the surroundings.

Proportional Fault

The fault is calculated as a percentile and the driver of the vehicle who is determined liable has to pay the damages.

If both parties are equally at fault, then they can both collect damages; however, if one of them is even slightly at more fault, they will have to pay all the damages. This includes all the injuries and vehicle damages.
