How COVID-19 Affects Partner and Spousal Visas in the UK

The adversity caused by the coronavirus across the world has been unimaginable. During these extended periods of isolation, having your family around has been the only supporting factor for many.

It has been especially hard for those separated from family in foreign countries due to rejected visa applications. Similar is the case for UK Spousal visa. Normally the visa that took a few months to process requires great amounts of effort and struggle now.

Applying for Spouse or Partner Visa

Every few months, the UK government revises the immigration rules and regulations according to the onset of the virus. The prerequisite of applying for a spouse or partner visa is to apply from some other state than the UK.

After the pandemic, the people residing within the UK whose visa expired after 31 October 2020 are to submit an urgent application to appeal and apply from within the country. The applicant must submit all details in the form of a cover letter of why they should be allowed to apply for the UK spousal visa while staying there.

Any applicant whose case is not urgent may apply for short-term protection against any adverse action taken once their leave has expired. In case of no urgency, applicants may leave the UK and apply for clearance from outside the country the regular way.

There is a slight uncertainty around what cases are considered urgent and those that aren’t. Your reason must be valid for why you are unable to travel outside the UK to apply for the pass. The Home Office will make decisions, which will be made by evaluating cases individually. Read up on the family policy published by the Home Office for more details.

Financial Requirements

Financial constraints have resulted in many losing jobs and being unable to support their families during the pandemic.

The government has successfully run a Coronavirus Job Retention Scheme that has helped many during these financially restraining times. This period, known as a flexible furlough, has provided UK employers up to 80 percent of their wage.

The immigration policies are constantly revising; therefore, keep yourself updated by consulting our highly trained and experienced team of UK Immigration lawyers.
