  • Absences calculated across your full qualifying period
  • Life in the UK and English evidence verified

Table of Contents

What do you check on an ILR application?

A solicitor reviews your draft form and evidence against the settlement rules for your route and advises you on each gap.

  • Qualifying period and visa history across every grant of leave
  • Continuous residence and absences, day by day
  • Route requirements: income for partners, salary and sponsor for Skilled Workers
  • English language and Life in the UK test evidence
  • Suitability: criminal record, immigration breaches, NHS debts
  • Dependants applying with you

Which ILR documents do you check?

We check the evidence for your route plus the documents every settlement applicant needs.

  • Passports covering the full qualifying period, and eVisa share code
  • Travel history with dates of every absence
  • Life in the UK test pass notification
  • English test certificate or degree evidence
  • Partner routes: relationship, income and accommodation evidence
  • Skilled Worker routes: sponsor letter, payslips, P60s
  • Evidence for dependent children

See documents required for ILR.

Which ILR requirements do you test?

We test the requirements in force on the date you apply.

  • Full qualifying period on an eligible route, usually 5 years
  • Continuous residence within the absence limits for your route
  • Life in the UK test passed
  • English at B1, or a valid exemption
  • No suitability grounds for refusal

The English level for settlement rises to B2 for applications made on or after 26 March 2027. The proposed "earned settlement" model, with a 10-year baseline, is not yet law as of October 2026, so the current 5-year routes remain open. More detail: ILR requirements and continuous residence.

What mistakes do you find most often?

Most problems we find are absence miscounts and gaps in route evidence that the applicant didn't know were needed.

  • Absences miscalculated or not declared
  • A gap between visas breaking continuous residence
  • Partner income evidence for the wrong period
  • Life in the UK pass not linked to the right identity document
  • Old convictions or fines not declared

How does the ILR application checking service work?

You complete the application yourself, a solicitor checks it, and you submit once every issue is fixed.

  1. Complete your online application on GOV.UK and save it as a draft, without paying or submitting.
  2. Book the application checking service online or call Wembley Solicitors on 020 3417 3700.
  3. Send us copies of your draft form, travel history and supporting documents.
  4. A solicitor checks every answer and document against the Immigration Rules, including continuous residence and absence limits.
  5. We go through the findings with you online, by phone or face-to-face, and explain how to fix each issue.
  6. Make the corrections, then submit on GOV.UK, pay the Home Office fee, and complete your identity check.

How long does an ILR document check take?

Most ILR document checks are completed within 1-3 working days of receiving all your documents.

  • Standard: completed within 1-3 working days
  • Same day: available depending on the complexity of your case, confirmed when you book
  • One-off service, with no retainer or ongoing fees

When should I book an ILR document check?

Book 3-4 weeks before you plan to apply. You can usually submit up to 28 days before you complete your qualifying period.

  • Apply before your current visa expires
  • Life in the UK test bookings can take several weeks
  • If you're relying on B1 English, apply before 26 March 2027
  • A same-day appointment may be possible for urgent cases, depending on complexity

Not yet. As of October 2026, no rules introducing the 10-year baseline have been laid down, so you can still apply under the current 5-year rules. We check your position against the rules on your application date.

If you only have B1 English, applying before that date avoids the new B2 requirement. We can check your timing as part of the review.
